Terms, Conditions and Consent
We offer to supply our services to you on the terms and conditions contained in this document. We also need your consent to do certain things on your behalf, and to pass on the information you give us to certain people or organisations for the reasons we explain below. Please read the following carefully, and if you agree with what we have asked, please tick the box to accept these terms and conditions. 1. What we ask you to do:
a. You agree that:
i. all information you supply will be complete, accurate and truthful;
ii. any documents, qualifications or questions you need to do as part of any application process will be completed by you alone and be truthful and legitimate;
iii. you will directly notify both International Students Online (or it’s education agents) and the academic institution you are applying to immediately should any information you give us cease to be complete, accurate and truthful;
iv. you will only use our system tools for the purpose of assisting you select an appropriate study pathway in Australia and making application to study such course. This includes not doing anything to interfere with the functioning of our system or anyone elses applications within the system; and
v. we retain ownership of the software behind our system and that you will not take any steps to reverse engineer, decompile, translate, disassemble or discover the source code of all or part of our software.
b. You acknowledge that you are solely responsible for the completeness, accuracy and truthfulness of all information that you give to us.
c. If you are offered and accept a place on a course, you undertake to obey the Rules, Regulations, Statutes and Ordinances of the academic institution, and to ensure payment of all fees and other liabilities for the course you apply to. You understand that you are solely responsible for paying any applicable fees or other liabilities involved in applying to or undertaking the courses you choose and, in particular, that we cannot be responsible for any changes to course or fee details.
2. Education Provider Discussion Forum -
Rules
Registration allows you to post comments and speak on the discussion forum and we encourage you to ask questions and share experiences, good and bad, so that everyone else can learn. We do, however, insist that you abide by the rules and policies detailed below.
Although the education agents, eduation providers and moderators of Internationl Students Online will attempt to keep all objectionable messages off this forum, it is impossible for us to review all messages and comments made. All messages express the views of the author, and neither the owners of International Students Online will be held responsible for the content of any message.
By agreeing to these rules, you warrant that you will not post any messages that are blatant promotion taht adds no value to the International Students Online Discussion Forum, defamatory, motivated by racial hatred, obscene, vulgar, sexually-oriented, hateful, threatening, or otherwise in violation of any laws.The owners of the International Students Online Discussion Forum reserve the right to remove, edit, move or close any thread for any reason.
3. Your Privacy
a. Your privacy is respected by us. The information, including sensitive information about your country of origin and first language, that you provide to us will only be provided to the following people or organisations for the purposes specified:
i. To the academic institutions you have nominated, to enable your application for entry to be considered by those academic institutions;
ii. To those academic institutions referred to in 3.a.i, or to other organisations or individual research workers for statistical or research purposes, but only in an anonymous form so that you cannot be individually identified;
iii. To any of the academic institutions referred to in 3.a.i, to enable that institution to initiate your student record;
iv. To any organisation, institution, employer or authority you have listed, to enable us or any of the academic institutions referred to in 3.a.i to verify details of the qualifications, employment or other experiences that you have described to us;
v. To any government agency or other party, as required by law.
b. In meeting any of the purposes described above, you acknowledge that we may need to send your information to other countries around the world.
c. If you dont supply all of the details we ask of you, we may not be able to process your applications.
d. You agree that we can ask any academic institution (and if requested, that you will instruct that institution) to which you are accepted, to send us information about when you commence an initial and any subsequent course of study with that institution.
e. If you would like to verify any of the information we hold about you, or if you have any general privacy concerns, please send an e-mail to info@internationalstudentsonline.com.au, and label the message "Attention: Privacy Officer".
f. If at any time after we have sent your application forms to the academic institutions you have nominated, you wish to verify the information those institutions hold about you, you will need to contact the relevant institutions directly.
4. Our Liability
a. You acknowledge that we:
i. have no control over the decision of an academic institution to accept or reject your application, and we are not liable for any decision an academic institution makes about your application;
ii. are not responsible for the failure of any institution to consider your application promptly, properly or at all;
iii. cannot promise that if we enter any data for applications on your behalf, that all data we enter will be error-free or free from delays;
iv. cannot promise that that the web site used and its server are free of computer viruses or other harmful mechanisms.
b. In any event, to the extent permitted by law and subject to sub-clause 4.c, International Students nline link shall not be liable for any damages whatsoever resulting from the supply of our services to you or the products used to supply those services, whether based in contract, tort or any other legal theory, and regardless of any notice we have given about the possibility of such damage.
c. If any legislation implies terms into the supply of our services that cannot be excluded, then our liability for breach of those terms is limited to supplying our services to you again, or paying the cost of having those services supplied to you by someone else.
5. Jurisdiction and Disclosure
The laws of Victoria, Australia shall apply to these terms, conditions and consent. If a dispute arises that we are unable to resolve to our mutual satisfaction, then either party may commence an action in a court of law in Victoria.
If we have assisted you with an application that leads to you commencing a course of study with an educational institution, that institution will pay International Students Online Pty Ltd a commission to help cover our costs in providing you with this service.
6. Acceptance
I agree to be bound by the terms and conditions contained on this form, and I give the consents which have been sought in this form, including consent to deal with my personal information in the ways described in this form.
